Slip and Fall

Falls are one of the primary reasons that people sustain serious injuries. Our office has successfully handled hundreds of slip and fall cases. In Tennessee, liability for slip and fall cases is based upon the fault, or negligence, of the owner, or occupier, of real estate. Contrary to the belief of many people, an owner or occupier of real estate is normally not responsible for the injuries sustained by a visitor just because the person fell upon another’s premises. In order to recover damages against a third party, the injured person must typically show that the landowner was negligent. In order to prove negligence, the injured person must show that the landowner created the hazard, or knew or should have known about the hazard, and failed to correct it. As a result, it is often very helpful if an investigation of the fall takes place immediately after the fall.Some of the causes for falls in cases that we have handled in the past are:
  • Improperly Designed Stairwell
  • Improper or no Handrails on Stairs
  • Spilled Diesel Fuel
  • Holes or Defects in Parking Lots
  • Leaking Refrigerators
  • Holes in Lawns
  • Spilled Liquids in a Store
  • Sidewalks that are Improperly Maintained
  • Automatic Doors that Malfunction
  • Ice or Snow on Sidewalks or Parking Lots
  • Improperly Designed and Maintained Decks

 

 

If you sustain injuries as a result of a fall, you should notify the owner of the premises. Video cameras sometimes will film a fall and provide valuable evidence. However, if the store does not know you have fallen, the tape will probably be destroyed. There are often witnesses to a fall and you should try to obtain the names and contact information for each witness. The scene of a fall will often change quickly so it is important that photographs be taken as soon as possible.
